Common questions
How do I get a divorce in Canada?
Under the federal Divorce Act, a divorce is granted when a marriage has broken down — most commonly shown by living separate and apart for at least one year. Issues such as parenting, support and property can be settled by agreement or decided by the court.
How are parenting arrangements decided?
Decisions are based on the best interests of the child, including the child's needs, relationships, safety and stability. Parents can agree on a parenting plan, or the court can decide parenting time and decision-making responsibility.
How is property divided when we separate?
In Alberta, the Family Property Act generally provides for property acquired during the relationship to be shared, with some exceptions. Timelines apply, so get advice early after separation.
